Terms and Conditions
Welcome to Rent Local Stuff (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your use of our website www.rentlocalstuff.com (the “Platform”), which enables users to list, discover, and hire tools, equipment, and other items (“Equipment”) from one another. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. About Rent Local Stuff
Rent Local Stuff is an online platform that connects individuals and businesses who wish to list their tools and equipment for hire (“Owners”) with people who wish to rent them (“Renters”). We do not own, inspect, supply, or guarantee any Equipment listed on the Platform and are not a party to any rental agreement entered into between an Owner and a Renter.
2. Eligibility
- You must be at least 18 years old and capable of entering into a binding legal agreement to use the Platform.
- By registering an account, you confirm that all information you provide is true and accurate.
- We reserve the right to suspend or terminate accounts that breach these Terms.
3. Use of the Platform
- Owners may list Equipment available for hire, including details such as description, condition, hire price, deposit amount, and availability.
- Renters may browse and request to hire Equipment directly from Owners.
- All hire arrangements, including payment terms, deposit, pick-up location, and return times, are agreed directly between the Owner and Renter.
- We may charge service or platform fees, which will be clearly displayed prior to booking.
4. Hire Agreements
When a Renter agrees to hire Equipment from an Owner, a separate rental contract is formed between the Owner and the Renter. We are not a party to this agreement and are not responsible for its enforcement. Owners are responsible for ensuring their listings are accurate, legal, and that they have the right to rent out the Equipment. Renters are responsible for returning the Equipment on time, in the same condition (allowing for fair wear and tear), and for using it safely and lawfully.
5. Deposits & Payments
Deposits and hire fees are determined by the Owner and displayed on the listing. The method and timing of deposit refunds are also agreed directly between the Owner and the Renter. We do not hold, manage, or guarantee return of deposits unless explicitly stated otherwise on the Platform.
6. Pick-Up & Return
All Equipment is pick-up only unless otherwise specified in the listing. The Owner and Renter are responsible for arranging a mutually agreed time and place for collection and return. Renters must inspect the Equipment upon pick-up and immediately notify the Owner of any visible issues.
7. Condition, Damage, and Loss
- Owners must ensure Equipment is in safe, working order and complies with relevant safety standards.
- Renters are responsible for the care and proper use of the Equipment during the hire period.
- Renters may be liable for repair or replacement costs in cases of damage, theft, or loss beyond normal wear and tear.
- Disputes regarding condition, damage, or costs are to be resolved directly between the Owner and the Renter.
8. Prohibited Uses
You agree not to:
- Use the Equipment for unlawful purposes or in a dangerous manner.
- Sublet, lend, or otherwise transfer the Equipment to a third party.
- Attempt to circumvent fees, payment processes, or other Platform functionality.
- Upload false, misleading, or defamatory content.
9. Our Role and Liability
We act solely as a platform provider. We do not own, test, certify, or guarantee any Equipment. We make no representations regarding the quality, safety, legality, or suitability of any Equipment or any Owner or Renter. To the fullest extent permitted by law, we exclude all liability for any injury, damage, loss, cost, or expense arising from any rental transaction or the use of any Equipment. Nothing in these Terms excludes liability for fraud, gross negligence, or where otherwise prohibited by law.
10. User Conduct and Account Termination
We may suspend, restrict, or terminate your account if we reasonably believe you have breached these Terms or engaged in fraudulent, harmful, or unlawful activity. You are responsible for all activity conducted under your account.
11. Intellectual Property
All content on the Platform (logos, text, graphics, etc.) is owned by or licensed to Rent Local Stuff. You may not copy, reproduce, distribute, or exploit any content without prior written consent.
12. Privacy
We collect and process personal information in accordance with our Privacy Policy. By using the Platform, you consent to such collection and use.
13. Disputes Between Users
Any disputes regarding payment, damage, returns, or other matters are between the Owner and the Renter. We may, at our sole discretion, assist in facilitating communication but are not obligated to resolve disputes.
14. Termination and Suspension of Platform
We reserve the right to modify, suspend, or discontinue the Platform (or any part of it) at any time without notice. We are not liable for any loss resulting from changes to or discontinuation of the Platform.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
16. Changes to These Terms
We may update these Terms from time to time. The latest version will always be posted on the Platform. Continued use of the Platform after changes are published constitutes acceptance of the revised Terms.
